David William Tyler represents
international and domestic corporations and individuals in a
wide range of complex commercial matters, including product
liability, class action, fraud, business disputes, internal and
government investigations, and other areas. Mr. Tyler has also
lectured and published articles on effective litigation
practices, use of experts in product liability cases, and qui
tam litigation, including matters brought under state and
federal False Claims Acts.
Prior to joining Herzfeld-Rubin, Mr. Tyler
served as senior in-house litigation counsel with a Fortune 500
company. Mr. Tyler’s time in-house provides him a unique
perspective that enables him to identify and focus on litigation
strategy coupled with clients’ practical business objectives.
For more than fifteen years, Mr. Tyler has dedicated himself to
obtaining the best results for his clients in the most creative,
efficient, and cost effective manner.
Product Liability. Mr. Tyler has
experience successfully representing manufacturers and other
corporate defendants in individual and class action product
liability matters in highly regulated fields, including the
automotive, medical device, pharmaceutical, and other
Insurance and Tort. Mr. Tyler
has represented corporate defendants, carriers, and insureds,
in a broad variety of insurance disputes and tort actions
from personal injury to environmental, toxic tort, and other
matters. Mr. Tyler has significant experience prosecuting
subrogation and direct actions on behalf of carriers seeking
to recoup policy losses.
Real Estate and Title. Mr. Tyler
has represented banks, landowners, title insurance
underwriters, and others in real estate and title litigation
matters, including numerous title claims, mortgage and
judgment lienholder rivalries, real estate fraud, boundary
line issues, rights of way and easement disputes.
Commercial Litigation and Business
Disputes. Mr. Tyler has represented individual and
corporate clients in a variety of commercial litigation
matters, ranging from breach of contract and business
disputes to fraud actions.
Compliance and Investigations.
Mr. Tyler has represented corporate clients in highly
regulated industries from healthcare to staffing, assisting
with internal and government investigations as well as
clients’ compliance initiatives.
Mr. Tyler is admitted to the bars of the
states of New York and New Jersey, the Southern District of New
York, the Eastern District of New York, and the District of New
Mr. Tyler is also deeply committed to
serving his community, having served on the board of directors
of a not for profit corporation he helped found, volunteering
time in a local food pantry, as well as organizing teams for and
participating in footraces benefitting various charitable
organizations. Mr. Tyler has also performed pro bono legal work
representing indigent victims of domestic violence. Mr. Tyler
graduated from the Fordham University School of Law where he was
a Senior Editor on the Fordham Environmental Law Journal and
most recently served on his graduation year’s reunion committee.
When not advocating on his clients’ behalf, Mr. Tyler enjoys
running and spending time with his family.
