Mark A. Weissman  is a business litigator with a proficiency in complex commercial litigation, media litigation, white-collar criminal defense and investigations. He has represented and counseled clients from diverse industries in a wide variety of matters, successfully litigating cases from the pre-trial level up to appeal in both federal and state courts. His commercial litigation background includes expertise in the areas of contracts, international commercial disputes, arbitrations, shareholder derivative actions, federal and state securities class actions, employment actions, civil RICO, bankruptcy, antitrust, and unfair competition.

His media litigation experience includes representing and counseling media organizations and reporters in the areas of First Amendment, libel, access, privacy, as well as trademark, copyright and technology litigation.

Mr. Weissman also has extensive experience representing and counseling both businesses and individuals in connection with state and federal criminal and regulatory investigations and actions including several major fraud prosecutions and related civil actions. He has successfully represented clients in matters before the United States Attorney's Office, the Securities and Exchange Commission, the New York Attorney General’s Office, and the Manhattan District Attorney’s Office. Among numerous other matters, his recent experience in this area includes:

  • Representing the audit committee and independent directors of a publicly traded U.S. defense contractor in connection with a federal criminal accounting fraud prosecution and in related private, civil litigation, including a federal securities class action.
  • Representing a director of a publicly traded technology company in connection with the federal “options-backdating” accounting fraud prosecution and in related private, civil litigation, including a federal securities class action and a shareholder derivative action.
  • Representing an employee of a publicly traded software and technology company in connection with the federal investigation and prosecution of the company’s violations of revenue recognition accounting rules and in related private civil litigation.
  • Representing several employees of a major media organization and its affiliates in connection with a federal fraud prosecution and a private, civil RICO action involving the alleged inflation of newspaper circulation figures.
  • Representing an international commercial bank in connection with the state investigation and prosecution of bank officers charged and convicted of a multimillion dollar embezzlement scheme.

Mr. Weissman is admitted to practice in the state courts of New York and the federal courts of the Southern and Eastern Districts of New York. He received his law degree from the University of Pennsylvania Law School in 1997, where he served as an editor of The University of Pennsylvania Law Review. He earned a dual undergraduate degree in Economics and Political Science, magna cum laude, from New York University, where he was elected Phi Beta Kappa. He is originally from Queens, New York and is a graduate of Stuyvesant High School.
