The AALS Torts & Compensation Systems Section has announced that Aaron Twerski (Brooklyn) will receive the 2016 Prosser Award. From the announcement:

On behalf of the Torts and Compensation Systems Executive Committee, it gives me great pleasure to announce that the recipient of the 2016 William L. Prosser Award is Aaron Twerski of Brooklyn Law School. Through his work as Co-Reporter for the Restatement (Third) of Torts: Products Liability, his own scholarship, his contributions to multiple casebooks, his exemplary teaching, and his generosity toward other scholars, Aaron Twerski has made “outstanding contributions ... in scholarship, teaching and service” of the kind that the Prosser Award was designed to recognize. I hope you will join the Executive Committee in offering our congratulations.

The award will be presented at our section meeting at 1:30 pm on January 8, 2016, during the AALS annual conference at the New York Hilton in New York City. We hope to see many of you there.

Our colleague, Mr. Ioan Baciu, in the Bucharest office, has been named an Associate Researcher at the Center for Good Governance Studies, a prestigious interdisciplinary research unit within the Public Administration Department of the Faculty of Political, Administrative and Communications Sciences of Babes Bolyai University, Cluj-Napoca, Romania where, together with the other researchers and experts, he will provide valuable input regarding the interface of regulations, state aid, competition law and procurement law. He will focus on the dynamics of good governance principles and transparency in public administration in the context of different legal institutions, predominantly with regard to public procurement and public private partnerships.

American Law Firm Herzfeld & Rubin Opens Office in Myanmar

Herzfeld & Rubin PC opened a law office in Yangon, Myanmar, last week, staffed by American and Myanmar attorneys. It is named Herzfeld, Rubin, Meyer & Rose Law Firm LTD. The firm also plans to open a satellite office in Myanmar’s capital Nay Pyi Taw.

Andrew Ngun Cung Lian, who was the deputy chief negotiator of the Chin National Front in its peace negotiations with the Myanmar government, will be managing director of the office and will lead a staff of five U.S. and Myanmar attorneys.

U Kyaw Hoe, a member of the National League for Democracy party’s Central Committee, heads HRMR’s litigation practice. He represents clients in contracts, real estate, labor and immigration law, as well as intellectual-property matters, the firm said.

“Herzfeld & Rubin’s attorneys have a rich history of helping develop legal frameworks in several emerging and frontier economies around the world, and our presence in Myanmar represents a substantial commitment to Southeast Asia,” Eric C. Rose, a principal of HRMR, said in a statement.

Based in New York, Herzfeld & Rubin has more than 200 attorneys there and four affiliated offices in the U.S., Europe and Israel, the firm said. The new office will be a full-service firm and will handle matters related to the emerging and frontier markets.

In September, Duane Morris LLP opened an office in Yangon as a branch of Duane Morris & Selvam LLP, a joint law venture the Philadelphia-based firm formed with Singapore-based Selvam LLC in 2010.

The foreign interest in Mynamar results from the European Union and other countries lifting most trade sanctions that were previously imposed on Myanmar. The country has implemented political and economic reforms under the leadership of President U Thein Sein. The country has abundant resources including natural gas, petroleum, timber, tin, zinc, copper, lead, coal, precious stones and fertile land, Herzfeld & Rubin said in their statement.

“The result of sweeping political and economic reform has ignited interest in Myanmar by American and other global investors -- including our clients,” Herzfeld & Rubin’s managing director, Ian Ceresney, said in a statement. “Their renewed focus in the region, and Southeast Asia generally, is the impetus behind our decision to establish a presence there.”

The Fifth and latest revision of the two volume New York Trial Notebook, authored by litigation department head Ed Birnbaum, litigation partner Carl Grasso, and Hon. Ariel Belen of the Appellate Division, Second Department, has just been published, and is available through James Publishing, Inc. This fifth annual revision to the original book, which first appeared in August 2005, is so extensively supplemented that rather than have subscribers fuss with switching pages, the publisher reprinted the entire book.

The New York Trial Notebook in its Fourth edition had been recently reviewed by Litigation Counsel of America’s Executive Director and General Counsel G. Steven Harvey. He wrote that the New York Trial Note book is  "perhaps the most practical, comprehensive and useful legal tool yet published. . . . it is difficult to conceive of a more complete resource for a trial lawyer than 'New York Trial Notebook' . . . It is easy to tell that the authors are experienced trial lawyers. It is though each is leaning over to the reader at counsel’s table saying 'Here’s what the law and rules say, but here’s how it really works.' . . . [The book’s] value is even greater than the dog-eared pocketbook of objections I have used since my very first year of practice. . . . Herzfeld and Rubin, P.C. mourns the loss of Justice Martin Evans, a unique human being, our colleague and our friend. Our hearts go out to his wife Meryle, his son Steve, and his grandchildren Arielle, Samuel and Danielle. Martin served as an Infantry Captain in the D-Day invasion of Normandy for which he was awarded the Chevalier of the French Legion of Honor by the President of France. This was a prelude to a career in the law in which honor and service were preeminent. The law truly was his life. As a lawyer and longtime Supreme Court Justice, he was distinguished for his wisdom, learning, judgment, unflappable temperament and integrity. He was President of the Supreme Court Justices Association and an active participant in Bar Association projects, both national and local. Until his last breath he was at work on projects to improve the judicial system, including as a member of the hard working Pattern Jury Instructions Committee. Edward L. Birnbaum has been chosen by the American Registry to be named amongst "America's Most Honored Professionals." Only ten percent of all recognized American professionals have been honored with this award. It is the only cross-profession, cross-industry honor based on a quantitative analysis of authenticated public recognitions.

He has also been selected to be a judge and evaluator at the St. John’s University School of Law 2011 National Civil Rights Trial Competition to be conducted in the courthouse.

Edward L. Birnbaum has again been named in AVENUE magazine as one of the City's top litigators in the 2011 publication. Edward L. Birnbaum has been retained by CLE 123 Lecture Series to record a series of lectures on trial practice. It is anticipated that the lecture recordings will include commentaries by a Justice of the Appellate Division, Second Department adding "comments from the Bench" to his comments as the Advocate.

On May 17th, Fairleigh Dickinson University bestowed the degree of Doctor of Humane Letters, honoris causa, upon our colleague, Mark A. Meyer. Lauding his wisdom, courage and compassion, the University citation reads, in part: “Fairleigh Dickinson applauds you as an honored son for embracing the promise of other cultures, working tirelessly to promote the rule of law in a developing region and building international relationships based on mutual cooperation.”

In his commencement address to the over 12,000 persons gathered at the IZOD Center in the Meadowlands, New Jersey, Mark told the nearly 3,000 graduates that “the future belongs to those who believe in the beauty of their dreams,” and he urged the students to “do something in your life that you will be able to take pride in when you turn 90.”

In 2007, St. John’s University School of Law bestowed the degree of Doctor of Laws, honoris causa, upon Mark Meyer, similarly lauding his achievements, describing him as “a pioneer in promoting the rule of law in Central and Eastern Europe since 1990.”

Edward L. Birnbaum has been asked to join a select group of NY lawyers to serve on a blue ribbon panel to evaluate the qualifications of nominees for addition to the 2011 Super Lawyers Panel. 5% of the attorneys in the New York metropolitan area will ultimately be selected for inclusion in the 2011 Super Lawyers publication.
