Maureen Doerner Fogel is a member of Herzfeld & Rubin, P.C. specializing in commercial counseling and litigation, insurance coverage, employment matters, complex tort/product liability and class actions. She has over thirty years of experience and has, during that time, developed a relationship of trust with both existing and new clients based on her dedication to service and each client's unique legal needs. Ms. Fogel is admitted in the state and federal courts of New York and New Jersey and handles complex litigation on a daily basis for clients ranging from multi-national and national companies to individual litigants. Her diverse experience includes a wide variety of matters including, for example, all phases of commercial disputes, contract litigation, insurance coverage, real estate disputes, and the defense of manufacturers and distributors in product liability and tort claims for automotive, commercial equipment and consumer products.

Ms. Fogel has significant expertise in the representation of automotive and consumer product industry clients defending design, manufacture and warranty claims and has handled New York product liability litigation for various manufacturers for two decades. She counsels and guides industry executives and key employees in thorough preparation and defense of challenging depositions and complex discovery, including electronic discovery issues, up through and including all phases of trial. She has significant expertise in the selection, preparation and successful use of experts for trial. Ms. Fogel has also defended pharmaceutical clients and been involved in Repetitive Stress Injuries & HIV mass tort litigation involving hundreds of consolidated actions.

Ms. Fogel's broad-based commercial experience includes insurance coverage declaratory judgment actions, breach of contract actions, class actions, shareholder derivative actions and employment discrimination. A representative sampling of her diverse clients include multi-national and national businesses, foreign governments, entertainment, retailers/importers in trademark claims concerning parallel imports; shareholders in contract and dissolution proceedings; persons who have suffered employment discrimination as well as companies defending discrimination claims.

In addition to litigation, Ms. Fogel’s practice routinely encompasses guiding clients in litigation avoidance techniques and strategies.  She provides practical and cost effective advice to clients on how to recognize and effectuate “best practices” guidelines for commercial and employment law matters, insurance coverage issues and strategy.

Ms. Fogel holds an “AV-rated preeminent” peer review rating by the Martindale-Hubbell directory of attorneys, has been named a Top Woman Attorney in NYC by Avenue Magazine, and is a fellow of the Litigation Counsel of America, a trial lawyer honorary society.  She is a member of the Association of the Bar of the City of New York, where she has served as a member of the Product Liability Committee, the Tort Committee and past Co-Chair of the Tort Section’s Legislative Sub-Committee.  She is also a member of the New York State Bar Association and Defense Research Institute. She lectures periodically for the Association of the Bar of N.Y.C., including a symposium on Women in Product Liability, as well as Stafford Continuing CLE on the Use of Experts in Insurance Coverage, and Herzfeld-Rubin’s in-house CLE programs on Employment Law, Product Liability, and Trial Practice including jury selection techniques and the selection and best use of experts.

She is a graduate of Southampton College, Long Island University (1981) and Hofstra University School of Law (1984). At Hofstra, Ms. Fogel was a member of the Hofstra Labor Law Journal, Notes and Comments Editor and Property Law Fellow.
